WRENTHAM, Mass. – Charges against two Rhode Island men have been withdrawn in relation to the death of a fan after an altercation in a game of New England patriots in 2023.
Justin Mitchell and John Vieira He declared himself innocent to minor crimes of assault and aggression and disorderly conduct. They were accused of hitting Dale Mooney, 53, from Newmarket, New Hampshire.
The charges were retired on Friday “in the interest of justice,” said Norfolk district prosecutor Michael Morrissey, in a judicial presentation. No more explanation was given.
The researchers said Mooney was beaten during an altercation in the Gillette stadium game, which ended in a 24-17 victory by Miami Dolphins visitors. Mooney was taken to a hospital, where he was declared dead.
“The stadium video showed that Vieira was only trying to help another individual to defend against an assault not caused,” said Peter Aspesi, a Vieira lawyer, in a statement.
A message looking for comment was sent by email on Tuesday to Mitchell’s lawyer, Daniel Gelb.
